Terms and conditions for using SmartID services.

1. Acceptance of Terms
By accessing or using SmartID services (SmartID EDUTIME, EDUCAFE, TIME, CAFE and PAY) operated by Pointgate Systems Sdn Bhd, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
2. Description of Services
2.1 SmartID EDUTIME
Palm-vein biometric attendance and leave management for schools and educational institutions.
2.2 SmartID EDUCAFE
Cashless canteen point-of-sale with palm biometric payment verification for schools.
2.3 SmartID TIME
Biometric attendance and leave management for corporate organisations.
2.4 SmartID CAFE
Cashless pantry and café point-of-sale with palm biometric payment verification for organisations.
2.5 SmartID PAY
Digital wallet and top-up platform supporting the cashless payment services.
3. User Accounts
3.1 You must create an account to use our services. You are responsible for maintaining the confidentiality of your account credentials.
3.2 You must provide accurate, current, and complete information during registration.
3.3 You are responsible for all activities that occur under your account.
3.4 You must notify us immediately of any unauthorised use of your account.
3.5 We reserve the right to suspend or terminate accounts that violate these terms.
4. Biometric Data Consent
By using our biometric authentication features, you consent to:
- Collection and processing of your palm-vein biometric data.
- Storage of encrypted biometric templates in our secure database.
- Use of biometric data solely for authentication purposes.
- Our privacy practices as outlined in our Privacy Policy.
You may withdraw consent at any time by requesting deletion of your biometric data through the institution or by contacting us.
5. Acceptable Use
You agree NOT to:
- Use the services for any illegal or unauthorised purpose.
- Violate any laws in your jurisdiction.
- Attempt to gain unauthorised access to our systems.
- Interfere with or disrupt the services or servers.
- Transmit viruses, malware, or other harmful code.
- Impersonate another person or entity.
- Harvest or collect information about other users.
- Use the services to send spam or unsolicited messages.
6. Payment Terms
6.1 Subscription fees are billed in advance on a monthly or annual basis.
6.2 All fees are in Malaysian Ringgit (RM) unless otherwise stated.
6.3 Fees are non-refundable except as required by law or as stated in our refund policy.
6.4 We reserve the right to change pricing with 30 days notice.
6.5 Failure to pay fees may result in suspension or termination of services.
7. Intellectual Property
7.1 All content, features, and functionality of our services are owned by Pointgate Systems Sdn Bhd and are protected by copyright, trademark, and other intellectual property laws.
7.2 You are granted a limited, non-exclusive, non-transferable licence to use our services for their intended purpose.
7.3 You may not copy, modify, distribute, sell, or lease any part of our services without our written permission.
8. Data and Content
8.1 You retain ownership of any data or content you upload to our services.
8.2 You grant us a licence to use, store, and process your data to provide our services.
8.3 We will handle your data in accordance with our Privacy Policy.
8.4 You are responsible for backing up your important data.
9. Service Availability
9.1 We strive to maintain high uptime but do not guarantee uninterrupted service availability.
9.2 We may temporarily suspend services for maintenance, updates, or emergencies.
9.3 We are not responsible for service interruptions caused by third-party providers or circumstances beyond our control.
10. Limitation of Liability
To the maximum extent permitted by law, Pointgate Systems Sdn Bhd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:
- Your use of, or inability to use, the services.
- Any unauthorised access to or use of our servers and/or personal information.
- Any interruption or cessation of transmission to or from our services.
- Any bugs, viruses, or other harmful code.
- Any errors or omissions in any content.
11. Indemnification
You agree to indemnify and hold harmless Pointgate Systems Sdn Bhd, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of our services or violation of these terms.
12. Termination
12.1 You may terminate your account at any time through your account settings or the institution.
12.2 We may suspend or terminate your account immediately if you violate these terms.
12.3 Upon termination, your right to use the services will cease immediately.
12.4 We will delete your data within 30 days of account termination, subject to legal retention requirements.
13. Governing Law
These Terms of Service are governed by the laws of Malaysia. Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the courts of Malaysia.
14. Changes to Terms
We reserve the right to modify these terms at any time. We will notify users of material changes through our services or the institution. Your continued use of our services after changes constitutes acceptance of the modified terms.
